1. Agreement to Terms
By accessing the website and services provided by VDM Hosting Solutions ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you are prohibited from using our services.
2. Scope of Services
VDM Hosting Solutions provides administrative support and management services for short-term rental owners ("Owners"), specifically for platforms like Airbnb. Our services include, but are not limited to, listing optimization, guest communication, and booking management. We act solely as an independent contractor and not as an employee, partner, or joint venture of the Owner.
3. Relationship with Hosting Platforms
VDM Hosting Solutions is an independent service provider and is not affiliated with, endorsed by, or sponsored by Airbnb, VRBO, or any other hosting platform. We do not guarantee any specific search ranking, booking volume, or revenue. The Owner remains solely responsible for complying with the terms and conditions of the respective hosting platforms.
4. Limitation of Liability
To the maximum extent permitted by applicable law, VDM Hosting Solutions shall not be liable for:
Any physical damage to the property caused by guests or third parties.
Theft or loss of personal property within the managed premises.
Personal injury or death occurring on or about the property.
Any loss of revenue, profits, or data.
Fines or legal actions taken by local authorities against the Owner for short-term rental activities.
Our total liability for any claim arising out of these terms shall not exceed the total amount of fees paid by the Owner to us during the three (3) months preceding the event giving rise to the claim.
5. Owner Responsibilities and Indemnification
The Owner represents that they have the legal right to rent the property and have obtained all necessary permits and insurance. The Owner agrees to indemnify, defend, and hold harmless VDM Hosting Solutions from any and all claims, damages, liabilities, and expenses (including legal fees) arising out of the condition of the property or the Owner’s breach of any local laws or platform regulations.
6. Fees and Payment
The Owner agrees to pay the fees as specified in the individual service agreement. Unless otherwise agreed, fees are non-refundable. VDM Hosting Solutions reserves the right to suspend services if payments are not made on time.
7. Governing Law and Arbitration
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. You hereby waive your right to participate in a class action lawsuit or class-wide arbitration.
8. Modifications
We reserve the right to modify these terms at any time. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
